McColl files affidavit supporting Museum Foundation’s plans for property

As York County and the Culture and Heritage Commission prepare to go to court over what the foundation can and cannot do with 400 acres of donated land on the Catawba River, an affidavit has since surfaced from the woman who donated that property.

In an affidavit submitted to the York County Clerk of Court on July 9, Jane Spratt McColl wrote the gift was, “an unrestricted and outright gift to the Culture and Heritage Foundation and not York County or the Culture and Heritage Commission.”

McColl adds the Foundation has kep her abreast of their plans for the property, including sales of portions of the gift.

In 2011, Carolinas Healthcare Systems purchased 21 acres of property for a future hospital in Fort Mill.

Earlier this year, the Fort Mill School District bought 39 acres for the site of a future school.

York County filed suit against the Culture and Heritage Foundation in June, saying the non-profit has refused to share information about its plans for the land.

Some members of York County Council have openly objected to the lawsuit, estimating total legal fees could exceed $250,000.
